four、施工總承包單位職責:按照規(guī)定開(kāi)設農民工工(gōng)資專用賬戶;存儲工資保證(zhèng)金,可以用金融機構保函替代;與分包單位(wèi)依法訂立書麵分包合同,應當約定工程款計量周期、工程款進度結算辦法;根據分(fèn)包(bāo)單位編製的工資支付表(biǎo),通過農民工(gōng)工(gōng)資專用賬戶直接將工資支(zhī)付到農民工本人的銀行賬戶,並向分包單位提供代發工資憑證;在工程項目部配備勞資專管員,對分包單(dān)位勞動用工實施監督管(guǎn)理;轉包(bāo)導致拖欠的,由施工總承包單位先行清償,再依法進行追償;分(fèn)包單(dān)位(wèi)拖欠農民工工資的,由施工總承包(bāo)單位(wèi)先行清償,再依法進行追償;施工單位允許其他單位和個人以施工單位的名義對(duì)外承(chéng)攬建設工(gōng)程,導致拖欠農民工工資的,由施工單位(wèi)清償;在施工現場醒目位置設立維權信息告示牌;與建設單位因工程數量(liàng)、質量、造價等產生爭議的,不(bú)得不按照規定代發工資;建(jiàn)立用工管理台賬,並保存至工程完工且工資全部結清後(hòu)至少threeyear;工程完工且未拖欠農民工工資的(de),施工總承包單位公示three0日後,可以申(shēn)請注銷農民工(gōng)工資專用賬戶,賬戶內餘額歸施工總承包單位所有。

機關、事業單位和大型企業遲延支付中小企業(yè)款項的,應當支(zhī)付逾期(qī)利息。雙方對逾期利息的(de)利率(lǜ)有約定的,約定利率不得低於(yú)合同訂立時oneyear期貸款(kuǎn)市場報價利率;未作約定的(de),按照每日利率萬分之五支付逾期利息(xī)。

改革後:工程勘察資質分為綜合資質和專業資質;工程設計資質分為綜合(hé)資質、行業資質、專(zhuān)業和(hé)事務所資質;施(shī)工資質分為綜合(hé)資質、施工總承包資質、專(zhuān)業承包資(zī)質和專業作業(yè)資質(zhì);工程監理資質分為綜合資質和專業資(zī)質。資質等級原則上壓減為甲、乙兩級(部分資質隻設甲級或不分等級),資質等級壓減後,中小企業承攬業務範圍(wéi)將進一步放寬,有利於促進中小(xiǎo)企業發展。
文件還提到做(zuò)好(hǎo)資質標準修訂和換證工(gōng)作,確保(bǎo)平穩過渡,設置oneyear過渡(dù)期,到期後實行簡單換證,即按照新舊(jiù)資質對應關係直接換發新資(zī)質證書,不再重新核定資質。

two thousand and twentyyearonetwomonthnine日,住(zhù)房和城鄉建設部印發《建築市場信用信息(xī)分級標準(征求意(yì)見稿)》並向社(shè)會公開征求意見。加快推進建築(zhù)市場信用體係建設、規範建築市場秩序。
明(míng)確:one、建築市(shì)場失信行為信息實行分級管理,按照性質、危害程度的不同分為A級、B級、C級等失信等級。A級失信行為信息的公開期限為six個month——threeyear;B級失信行為信(xìn)息的公開期限(xiàn)為three個month——oneyear;C級失信行為信息的公開期限(xiàn)為one個month——six個month。建築市場主(zhǔ)體“黑名單”信息管(guǎn)理(lǐ)期(qī)限為自被(bèi)列入名(míng)單之日起oneyear。
